COVID-19 : NOVEL CORONAVIRUS

Please find below a selection of recent legislation changes relating to COVID-19 and communications for workplaces from key safety and environmental regulators in Australia and New Zealand.

LEGISLATION CHANGES

Public Health (Jervis Bay Territory) Emergency Declaration Further Extension (No. 1) 2021

  • Extends the Public Health (Jervis Bay Territory) Emergency Declaration 2020 for 90 days.


Public Health (COVID-19 Interstate Hotspots) Emergency Direction 2021 (No 7)

  • Requires affected persons who are residents of the ACT to undertake a period of quarantine at designated premises and to complete a self-declaration form, prohibits affected persons who are not residents of the ACT from travelling to the ACT unless they have an exemption, and requires affected persons with an exemption to quarantine at designated premises.

Public Health (Residential Aged Care Facilities) Emergency Direction 2021 (No 1)

  • Provides for restricted access to residential aged care facilities in order to limit the spread of COVID-19 within a particularly vulnerable population.


Declaration of Isolation Areas

  • Declares certain areas to be an isolation area for two months on and from 1 February 2021.


Emergency Management (Cross Border Travel No 29) (COVID-19) Direction 2021

  • Replaces the Emergency Management (Cross Border Travel No 28) Direction 2020, prohibits certain persons from entering South Australia, and directs certain persons to quarantine, submit to COVID-19 testing and wear face masks.

Emergency Management (Supervised Quarantine No 3) (COVID-19) Direction 2021

  • Replaces the Emergency Management (Supervised Quarantine No 2) (COVID - 19) Direction 2020, and sets out testing requirements for certain employees and contractors and persons undertaking supervised quarantine.


Directions in Relation to Persons Arriving in Tasmania

  • Requires persons arriving in Tasmania to answer certain questions, comply with directions of the Director of Public Health, and remain in their room if required to isolate in an accommodation facility, prohibits (except with prior approval) persons from arriving at King Island, Flinders Island or any island in the Furneux Group of Islands if required to isolate in an accommodation facility, and prohibits affected persons from entering Tasmania except in certain circumstances.


Stay Safe Directions (Victoria) (No 10)

  • Requires residents of Victoria to wear face coverings and limits interactions with others by restricting gatherings - came into force at 11.59 pm on 17 January 2021.

Victorian Border Crossing Permit Directions (No 3)

  • Replaces the Victorian Border Crossing Permit Directions and clarifies some restrictions already in place to limit the spread of COVID-19 - came into force 11.59 pm on 17 January 2021.

Workplace Directions (No 17)

  • Limits the number of Victorians attending work premises to assist in reducing the frequency and scale of COVID-19 outbreaks - came into force at 11.59 pm on 17 January 2021.

Extension of State of Emergency Declaration

  • Extends the State of Emergency Declaration made on 15 March 2020 for 14 days until 12 am on 21 January 2021.

COVID-19 Public Health Response (Air Border) Order (No 2) Amendment Order 2021

  • Amends the COVID-19 Public Health Response (Air Border) Order (No 2) 2020 to require pre-departure testing for COVID-19 in respect of specified places.

Designation of Specified Places - COVID-19 Public Health Response (Air Border) Order (No 2) 2020

  • Designates the United Kingdom and United States of America as specified places for the purposes of the COVID-19 Public Health Response (Air Border) Order (No 2) 2020.

Exemption of Persons from Clause 8 of the COVID-19 Public Health Response (Air Border) Order (No 2) 2020

  • Exempts certain persons from certain obligations on air arrivals (Clause 8 of the COVID-19 Public Health Response (Air Border) Order (No 2) 2020).

Exemption of Persons from Clause 8(2B) of the COVID-19 Public Health Response (Air Border) Order (No 2) 2020

  • Declares that certain persons are exempt from clause 8(2B) (obligations on persons arriving in New Zealand by air) of the COVID-19 Public Health Response (Air Border) Order (No 2) 2020.

Specification of Appropriate Evidence Relating to a COVID-19 Test - COVID-19 Public Health Response (Air Border) Order (No 2) 2020

  • Defines ‘appropriate evidence’ for the purpose of the COVID-19 Public Health Response (Air Border) Order (No 2) 2020.

Specification of Examination or Test for COVID-19 - COVID-19 Public Health Response (Air Border) Order (No 2) 2020 

  • Designates certain examinations or tests for COVID-19 to be a COVID-19 test for the purposes of the COVID-19 Public Health Response (Air Border) Order (No 2) 2020.
